Vitalik Buterin Endorses FOCIL as Ethereum Prepares for Hegota Upgrade

Ethereum’s development community is gearing up for a significant upgrade scheduled for the latter half of 2026. The upcoming hard fork, named Hegota, will introduce a critical new feature known as Fork-Choice Enforced Inclusion Lists (FOCIL). This enhancement has recently been backed by Ethereum co-founder Vitalik Buterin, marking a pivotal moment in the network’s push toward censorship resistance and transaction inclusion fairness.
What is FOCIL?
FOCIL — formally proposed as EIP-7805 — is designed to ensure that any valid transaction present in Ethereum’s public mempool (the waiting area for unconfirmed transactions) is included in a block within a bounded number of slots. This mechanism operates by empowering a committee of validators to enforce the inclusion of transactions using fork-choice rules and curated inclusion lists. If a block proposer excludes transactions listed for mandatory inclusion, the network protocol can respond by forking away from that block altogether, ensuring compliance.
This system directly tackles ongoing concerns regarding censorship and arbitrary transaction exclusion. In the past, certain validators have filtered out transactions linked to sanctioned addresses or services — like Tornado Cash, a privacy protocol subject to OFAC sanctions. With FOCIL, validators are mandated to include any valid transaction, regardless of origin, thus promoting a more censorship-resistant Ethereum.
Vitalik Buterin’s Support and Vision
Vitalik Buterin expressed strong support for the upgrade on social media platform X (formerly Twitter), highlighting how FOCIL complements another key proposal, EIP-8141. The latter focuses on native protocol support for advanced functionalities such as smart wallets, multisignature configurations, quantum-resistant keys, and gas-sponsored transactions. Together, these proposals aim to create a robust transaction inclusion mechanism, where up to 17 independent actors — including block proposers and inclusion list validators, selected randomly for every slot — can trigger a transaction’s inclusion on-chain.
Describing FOCIL’s impact, Buterin wrote, “FOCIL enables censorship-resistant rapid inclusion of any transaction,” noting that nearly any valid transaction would be included within one to two slots even under adversarial conditions. He concluded his message with enthusiasm: “Ethereum is going hard.”
Buterin also framed FOCIL as a foundational element of a broader ambition to develop a "cypherpunk principled non-ugly Ethereum." His vision incorporates censorship resistance, zero-knowledge proof compatibility, and simplified consensus protocols, aiming for a tight integration of these properties within the existing network’s fabric.
Controversy and Developer Concerns
Not all voices within the Ethereum development community are unreservedly optimistic about FOCIL. Developer Ameen Soleimani raised concerns back in August that forcing validators to include transactions from sanctioned addresses at the protocol level risks significant legal repercussions. He characterized the approach as “either naive or reckless,” arguing that compelling validators to enforce transaction inclusion constraints could create untenable pressures, even if driven by censorship resistance goals.
This debate underscores the complex balance Ethereum must maintain between technical innovation, legal considerations, and ideological commitments to openness and censorship resistance.
Looking Ahead: The Hegota Upgrade Timeline
The Hegota hard fork is set to follow the upcoming Glamsterdam upgrade, expected to roll out in the near term. While Glamsterdam will address immediate enhancements, Hegota will usher in these more ambitious protocol-level changes including FOCIL and EIP-8141. This staged upgrade approach highlights Ethereum’s iterative development model, allowing community discussion and refinement as new features are integrated over time.
